Blessings on Miṣwoth

Ṣiṣith

א. 1. A person is not obligated to buy a ṭallith, but anyone who wears a four-cornered garment is obligated to attach ṣiṣith (fringes) to it, and one who covered himself with it without ṣiṣith has nullified a positive miṣwa. A garment of wool or linen is obligated min hattora (by Torah law), and other materials middivre ḥăkhamim (by rabbinic law). Its minimum size is enough to cover the head and most of the body of a child who walks alone in the marketplace (Rambam, Ṣiṣith 3:1–2, 11; Shulḥan 'Arukh, ʾOraḥ Ḥayyim 8:17, 9:1, 16:1; Ben ʾIsh Ḥay, Year 1, Noaḥ 1, 3; Lekh Lĕkha 11).

ב. 2. The miṣwa of ṣiṣith applies by day, as it is said, "look at it". When one puts it on by day one recites the bĕrakha, from the time one can distinguish between its tĕkheleth (blue) and its white. It is permitted to wear it at night, whether on a weekday or on Shabbath, provided one does not recite the bĕrakha (Rambam, Ṣiṣith 3:7–8; Shulḥan 'Arukh, ʾOraḥ Ḥayyim 18:1, 3; Ben ʾIsh Ḥay, Year 1, Lekh Lĕkha 15–16).

ג. 3. A minor who knows how to wrap himself is obligated in ṣiṣith middivre sofĕrim (of rabbinic origin), in order to train him in miṣwoth. Women are exempt; if they wish to wrap themselves they do so without a bĕrakha, and some disagree and hold that they should not wrap themselves (Rambam, Ṣiṣith 3:10; Shulḥan 'Arukh, ʾOraḥ Ḥayyim 17:2, 3; Ben ʾIsh Ḥay, Year 1, Lekh Lĕkha 13–14).

ד. One may wrap oneself in a wide ṭallith either folded to half its width or spread open along its full length, for folding is not sewing (derived from Rambam, Ṣiṣith 1:17; Shulḥan 'Arukh, ʾOraḥ Ḥayyim 10:7). It is forbidden to embroider verses from the Torah or bĕrakhoth on a ṭallith (Tĕshuvoth HaRambam §268).

ה. 5. Before reciting the bĕrakha one examines the threads of the ṣiṣith to see that they are valid and separates them from one another. One recites the bĕrakha standing, then wraps oneself and covers one's head with the ṭallith, and places two ṣiṣiyyoth in front and two behind. If one took off one's ṭallith — even temporarily, intending to wrap oneself in it again right away — one recites the bĕrakha again upon wrapping oneself anew (Shulḥan 'Arukh, ʾOraḥ Ḥayyim 8:1, 2, 4, 7, 9, 14; and see Moram on paragraph 14; Ben ʾIsh Ḥay, Year 1, Bĕreʾshith 3, 6; and regarding temporary removal, where he is lenient, see Ben ʾIsh Ḥay, ibid. 10).

ו. A person should always strive to be wrapped in a garment that is obligated in ṣiṣith, for it is not fitting for a ḥasidh (pious person) to exempt himself from this miṣwa; and at the time of prayer one must be especially careful (Rambam, Ṣiṣith 3:12; Shulḥan 'Arukh, ʾOraḥ Ḥayyim 24:1). One should always be careful with the miṣwa of ṣiṣith, for Scripture weighed it and made all the miṣwoth depend on it, as it is said, "look at it and recall all Adhonay's commandments" (Rambam, Ṣiṣith 3:13).

Before wrapping oneself, one recites the bĕrakha standing:

barukh ʾatta Adhonay ʾĕlohenu melekh ha'olam, ʾăsher qiddĕshanu bĕmiṣwothaw wĕṣiwwanu lĕhith'aṭṭef baṣṣiṣith.

Blessed are You, Adhonay our God, King of the universe, who sanctified us with His commandments and commanded us to wrap ourselves in ṣiṣith.

Ben ʾIsh Ḥay wrote to say "bĕṣiṣith", with a shĕwaʾ under the beth rather than a pattaḥ (Ben ʾIsh Ḥay, Year 1, Bĕreʾshith 2); the wording here follows the siddur of Rav Qafiḥ.

Tĕfillin

א. It is a positive miṣwa min hattora (by Torah law) to put tĕfillin on the arm and to put them on the head (Rambam, Tĕfillin 4:1–2).

ב. 2. The place for the tĕfillin shel yadh (of the arm): one binds it on the left arm on the qibboreth, which is the bulging flesh of the upper arm, and tilts it slightly toward the body so that it is opposite the heart (Rambam, Tĕfillin 4:2; Shulḥan 'Arukh, ʾOraḥ Ḥayyim 27:1; Ben ʾIsh Ḥay, Year 1, Ḥayye Sara 6).

ג. 3. The place for the tĕfillin shel roʾsh (of the head) is on the crown, which is the place where an infant's skull is soft, in the middle of the head in line with the space between the eyes. The knot should be at the top of the nape, which is the end of the skull (Rambam, Tĕfillin 4:1; Shulḥan 'Arukh, ʾOraḥ Ḥayyim 27:9–10; Ben ʾIsh Ḥay, Year 1, Ḥayye Sara 1–3).

ד. 4. An ʾiṭṭer (left-handed person) puts tĕfillin on his right arm, which for him is like everyone else's left (Rambam, Tĕfillin 4:3; Shulḥan 'Arukh, ʾOraḥ Ḥayyim 27:6; Ben ʾIsh Ḥay, Year 1, Ḥayye Sara 7).

ה. When one places the tĕfillin shel yadh on the qibboreth, before binding it one recites the bĕrakha "lĕhanniaḥ tĕfillin", tightens the strap around the qibboreth, and continues winding it down the arm; one then stretches the strap across the hand and winds it around the middle finger, and afterward puts on the shel roʾsh (Rambam, Tĕfillin 4:7; 3:13).

ו. 6. It is forbidden to interrupt by speaking between the tĕfillin shel yadh and the shel roʾsh, even to return a greeting to one's teacher, because there is one bĕrakha for both. If one did interrupt by speaking between them, one has committed a transgression, and must recite another bĕrakha over the shel roʾsh, namely "ʾăsher qiddĕshanu bĕmiṣwothaw wĕṣiwwanu 'al miṣwath tĕfillin" (Rambam, Tĕfillin 4:6; Shulḥan 'Arukh, ʾOraḥ Ḥayyim 25:9; Ben ʾIsh Ḥay, Year 1, Wayyeraʾ 7, 10).

ז. 7. When one wishes to put on the shel roʾsh alone, one recites "'al miṣwath tĕfillin". The tĕfillin shel yadh does not prevent fulfilling the shel roʾsh, nor does the shel roʾsh prevent fulfilling the shel yadh (Rambam, Tĕfillin 4:4–5; Shulḥan 'Arukh, ʾOraḥ Ḥayyim 25:5; Ben ʾIsh Ḥay, Year 1, Wayyeraʾ 6).

ח. 8. The time for putting on tĕfillin is by day and not at night, as it is said, "from year to year" — from when one can see one's fellow at a distance of 4 ʾammoth (cubits) and recognize him (Rambam, Tĕfillin 4:10; Shulḥan 'Arukh, ʾOraḥ Ḥayyim 30:1–2; Ben ʾIsh Ḥay, Year 1, Ḥayye Sara 8).

ט. 9. Tĕfillin are not put on on Shabbath or on yom ṭov, as it is said, "And this shall serve you as a sign", and Shabbath and yom ṭov are themselves an ʾoth (sign) (Rambam, Tĕfillin 4:10; Shulḥan 'Arukh, ʾOraḥ Ḥayyim 31:1). On ḥol hammo'edh tĕfillin are not put on, by the minhagh of Teman and Sĕfaradh, for its days too are an ʾoth; and in Rav Qafiḥ's view it appears that this is also the opinion of Rabbenu (Shulḥan 'Arukh, ʾOraḥ Ḥayyim 31:2; Ben ʾIsh Ḥay, Year 1, Wayyeraʾ 12; Rambam, Tĕfillin 4:10, and Rav Qafiḥ's note there).

י. 10. Tĕfillin require guarding: one may not pass wind while wearing them, nor go with them into filthy places, nor let one's mind be diverted from them (Rambam, Tĕfillin 4:13–15; Shulḥan 'Arukh, ʾOraḥ Ḥayyim 37:2; Ben ʾIsh Ḥay, Year 1, Ḥayye Sara 16–17).

A minor who knows how to guard tĕfillin: his father acquires tĕfillin for him in order to train him in miṣwoth (Rambam, Tĕfillin 4:13; Shulḥan 'Arukh, ʾOraḥ Ḥayyim 37:3).

One should take care to take the shel yadh out of the bag first, so as to put it on first (Rambam, Tĕfillin 4:8; Shulḥan 'Arukh, ʾOraḥ Ḥayyim 25:1; Ben ʾIsh Ḥay, Year 1, Wayyeraʾ 19). If by mistake or by circumstance one took out the shel roʾsh first, one puts on the shel roʾsh first and recites "'al miṣwath tĕfillin", and afterward puts on the shel yadh and recites "lĕhanniaḥ tĕfillin", so as not to pass over miṣwoth; in Maran's view, one does pass over that miṣwa and puts on the shel yadh first (Rambam, Tĕfillin 4:8; Shulḥan 'Arukh, ʾOraḥ Ḥayyim 25:6).

When putting on the shel yadh, before binding it, one recites the bĕrakha:

barukh ʾatta Adhonay ʾĕlohenu melekh ha'olam, ʾăsher qiddĕshanu bĕmiṣwothaw wĕṣiwwanu lĕhanniaḥ tĕfillin.

Blessed are You, Adhonay our God, King of the universe, who sanctified us with His commandments and commanded us to put on tĕfillin.

When putting on the shel roʾsh alone, or if one interrupted by speaking between the shel yadh and the shel roʾsh, one recites the bĕrakha:

barukh ʾatta Adhonay ʾĕlohenu melekh ha'olam, ʾăsher qiddĕshanu bĕmiṣwothaw wĕṣiwwanu 'al miṣwath tĕfillin.

Blessed are You, Adhonay our God, King of the universe, who sanctified us with His commandments and commanded us concerning the miṣwa of tĕfillin.

Maran and Ben ʾIsh Ḥay wrote to say "lĕhaniaḥ", with a qamaṣ under the heʾ and without a daghesh (Shulḥan 'Arukh, ʾOraḥ Ḥayyim 25:7; Ben ʾIsh Ḥay, Year 1, Wayyeraʾ 9); the wording here follows the siddur of Rav Qafiḥ.

Immersion of a Nidda

א. 1. All who are ṭĕmeʾim have no ṭahŏra except through ṭĕvila (immersion) in the waters of a miqweh. A nidda does not emerge from her ṭumʾa until she immerses; waiting alone does not render her ṭĕhora, and even if all the waters of the world were to fall upon her she remains as she was. Washing in a bathtub is of no avail, for ṭumʾa is not physical dirt that water removes; rather, it is a gĕzerath hakkathuv, and the matter depends on kawwanath hallev (Rambam, Miqwaʾoth 1:1, 11:12; ʾIssure Viʾa 11:16, 18; Shulḥan 'Arukh, Yoreh De'a 201:1; Ben ʾIsh Ḥay, Year 2, Shĕmini 1).

ב. 2. A valid miqweh is gathered water containing 40 sĕʾa (the measure: 288 liters, or 77 US gallons), enough for a person's entire body to be covered at once, and which is not shĕʾuvim — that is, not drawn in a vessel. These are the waters that are naturally valid: a spring, the sea, a river whose waters flow, and a pit or pool in the ground in which rainwater has collected. For a river there are conditions, and one should ask a Rav (Rambam, Miqwaʾoth 4:1–2, 6:10, 9:5–8, 9:12; Shulḥan 'Arukh, Yoreh De'a 201:1; Ben ʾIsh Ḥay, Year 2, Shĕmini 1).

ג. 3. The woman immersing immerses her entire body and all her hair at once, in her natural posture, neither standing too upright nor bending too far, and nothing may be ḥoṣeṣ (an interposing barrier) between her and the water. The rule: something covering most of her body that she minds is ḥoṣeṣ min hattora; something covering only a small part of her body that she minds, or covering most of it that she does not mind, is ḥoṣeṣ middivrehem; something covering only a small part that she does not mind is not ḥoṣeṣ. Bĕdhi'ăvadh, if there is doubt whether something was ḥoṣeṣ, she does not immerse again except for a ḥăṣiṣa min hattora. Garments that the water enters are not ḥoṣeṣ: if she immersed in her clothes, the ṭĕvila is valid for her and she is permitted to her husband (Rambam, Miqwaʾoth 1:7, 10, 12; 2:22; Shulḥan 'Arukh, Yoreh De'a 198:1, 46).

ד. Rings and jewelry: if loose they are not ḥoṣeṣ, but if tight and clinging to the flesh they are ḥoṣeṣ; the custom is to remove them before the ṭĕvila (Rambam, Miqwaʾoth 2:4).

ה. 5. It is the widespread minhagh among all Sĕfaraddi women to remove all body hair that they ordinarily remove prior to ṭĕvila (such as the underarms, the legs, and the pubic area). If she forgot, and the hair is clean and not matted, the ṭĕvila is valid for her and she need not immerse again. But once hair has become knotted and matted it is ḥoṣeṣ if she minds it (Shulḥan 'Arukh, Yoreh De'a 198:6, and Birke Yosef ad loc.; Pithḥe Thĕshuva ad loc., §12; Darkhe Ṭahŏra, ch. 16; Ben ʾIsh Ḥay, Year 2, Shĕmini 7; Rambam, Miqwaʾoth 2:7, 15).

ו. 6. She recites the bĕrakha before the ṭĕvila, while still standing in her robe. It is good to cover her head during the bĕrakha; after the bĕrakha she removes her headcovering and robe and immerses. If she did not recite the bĕrakha then, she should recite it after entering the water up to her neck. She immerses only once, for one who immerses twice is acting improperly, and such is our minhagh (Shulḥan 'Arukh, Yoreh De'a 200:1; Ben ʾIsh Ḥay, Year 2, Shĕmini 19; Rambam, Bĕrakhoth 11:2; Miqwaʾoth 1:9).

It is good to say the verse "Wihi no'am" before the bĕrakha (Ben ʾIsh Ḥay, ibid.):

wihi no'am ʾădhonay ʾĕlohenu 'alenu uma'ăseh yadhenu konĕna 'alenu uma'ăseh yadhenu konĕnehu.

May the favor of my Sovereign, our God, be upon us; let the work of our hands prosper, O prosper the work of our hands! (Psalm 90:17)

Before the ṭĕvila she recites the bĕrakha:

Blessed are You, Adhonay our God, King of the universe, who sanctified us with His commandments and commanded us concerning immersion.

Immersion of Kelim

א. 1. Kelim (vessels) used for a meal that are made of metal or glass, and likewise a kĕli coated with lead on the inside, which a Jew acquired from a non-Jew — even if new — require ṭĕvila in a valid miqweh, after which it is permitted to eat and drink from them. This ṭĕvila is middivre sofĕrim (of rabbinic origin), and it is not a matter of ṭumʾa and ṭahŏra but is on account of gi'ule ghoyim. Kelim of wood and kelim of stone, however, do not require ṭĕvila (Rambam, Maʾăkhaloth ʾĂsuroth 17:3, 5, 6; Shulḥan 'Arukh, Yoreh De'a 120:1).

ב. 2. A kĕli that the non-Jew has used requires hakhsharath kelim (kashering) before the ṭĕvila (Rambam, ibid. 3–4).

ג. 3. One who borrows or rents a kĕli from a non-Jew need not immerse it; but if a Jew acquired it from a non-Jew and lent it to another, it requires ṭĕvila (Rambam, ibid. 6; Shulḥan 'Arukh, Yoreh De'a 120:8; Ben ʾIsh Ḥay, Year 2, Maṭṭoth 1).

ד. One must clean the kĕli of all dirt and rust so that there is no ḥăṣiṣa, and must immerse the entire kĕli, inside and out, putting it into the water so that not even a little of it remains outside the water. If it is a large kĕli, one may not immerse one side first and then the other, because all of it must be immersed at one time (Ben ʾIsh Ḥay, Year 2, Maṭṭoth 2, 17).

ה. If one is immersing several kelim, one recites "'al ṭĕvilath kelim"; if one is immersing a single kĕli, one recites "'al ṭĕvilath kĕli" (Shulḥan 'Arukh, Yoreh De'a 120:3; Rav Pĕ'alim, vol. 1, §18).

Before immersing, one recites the bĕrakha:

barukh ʾatta Adhonay ʾĕlohenu melekh ha'olam, ʾăsher qiddĕshanu bĕmiṣwothaw wĕṣiwwanu 'al ṭĕvilath kelim (kĕli).

Blessed are You, Adhonay our God, King of the universe, who sanctified us with His commandments and commanded us concerning the immersion of vessels (a vessel).

Immediately after the bĕrakha one immerses. While immersing, one should not grip the kĕli tightly but hold it loosely, and lĕkhattĕḥilla (ideally) one should first wet one's hands in the water of the miqweh itself (Shulḥan 'Arukh, Yoreh De'a 120:2; Ben ʾIsh Ḥay, Year 2, Maṭṭoth 40).

Affixing a Mĕzuza

א. 1. It is a positive miṣwa to write on qĕlaf (parchment) of hide the parasha "Shĕma' Yisraʾel" and the parasha "wĕhaya ʾim shamoa'", and to affix them to the doorpost of the entrance. Each time one enters and leaves, one encounters in it the unity of the Divine Name and remembers His love. A person's intention in placing it should not be for the sake of protection or reward, but to fulfill the miṣwa of the Creator, blessed be He (Shulḥan 'Arukh, Yoreh De'a 285:1; Rambam, Tĕfillin Umĕzuza 5:4, 6:13; Ben ʾIsh Ḥay, Year 2, Ki Thavoʾ 1).

ב. A house or room that is obligated in mĕzuza must meet ten conditions, and if one of them is lacking it is exempt: it must be 4 ʾammoth (cubits) by 4 ʾammoth or more; it must have two doorposts; a lintel; a ceiling; and doors; the entrance must be 10 ṭĕfaḥim (handbreadths) high or more; the house must be ḥol (not sacred); made for human habitation; for dignified habitation; and for permanent habitation. For the details of these laws, see chapter 6 there (Rambam, Tĕfillin Umĕzuza 6:1). Maran also obligates a cattle barn, poultry coops, storehouses of wine and oil, and a storehouse for straw or wood; ask a Rav (Shulḥan 'Arukh, Yoreh De'a 286:1–2).

ג. 3. How it is affixed: one rolls it from the end of the writing toward its beginning, so that "Shĕma'" is toward the outside. It is the widespread minhagh to write "Shadday" on its outer side, and once it is rolled "Shadday" should be visible on the outside. One places it in a tube and affixes it to the doorpost of the entrance with nails, or hollows out the doorpost and inserts it there; one should hollow out less than a ṭefaḥ (about 8 cm) and leave a little of the mĕzuza protruding so that it can be seen (Rambam, Tĕfillin Umĕzuza 5:4, 6, 8; Shulḥan 'Arukh, Yoreh De'a 289:4, 6; Ben ʾIsh Ḥay, Year 2, Ki Thavoʾ 14).

ד. 4. One affixes it within the outermost ṭefaḥ of the doorway's opening, on the right side of one entering; if one affixed it on the left, it is pĕsula (invalid). One places it at the beginning of the upper third of the entrance's height: that is, if the height of the entrance from the floor to the lintel is 1.80 meters, one places it at a height of 1.20 meters from the floor. If one affixed it higher than this it is kĕshera (valid), provided it is a ṭefaḥ away from the lintel. If one placed it below 1.20 meters, or placed it high up next to the lintel, it is pĕsula, and one must return it to its proper place without a bĕrakha. It must be placed upright, its length running along the doorpost of the entrance, and not diagonally as our ʾAshkĕnazzi brethren do. If one placed it diagonally, one must remove it and place it upright (Shulḥan 'Arukh, Yoreh De'a 289:2, 6; Rambam, Tĕfillin Umĕzuza 6:12; Ben ʾIsh Ḥay, Year 2, Ki Thavoʾ 7, 8).

Before affixing it, one recites the bĕrakha (Shulḥan 'Arukh, Yoreh De'a 289:1; Rambam, Tĕfillin Umĕzuza 5:7):

barukh ʾatta Adhonay ʾĕlohenu melekh ha'olam, ʾăsher qiddĕshanu bĕmiṣwothaw wĕṣiwwanu liqboa' mĕzuza.

Blessed are You, Adhonay our God, King of the universe, who sanctified us with His commandments and commanded us to affix a mezuzah.

After affixing it, one kisses it and says (Ben ʾIsh Ḥay, ibid.):

zeh-hashsha'ar laAdhonay ṣaddiqim yavoʾu vo.

This is the gateway to Adhonay—the victorious shall enter through it. (Psalm 118:20)
